Rusty Muck 4426 Posted November 22, 2017 Posted November 22, 2017 And the courts themselves are slowly but surely being molded into Der Führer Drumpf's image because Republicans have allowed it to be so by leaving open any vacancies left behind during the previous administration's tenure. Corporate America and government are one in the same now if not already. Yup. Paid Off will kill Net Neutrality outright with that 3-2 majority vote and that will be the ballgame. Nothing will stop Paid Off. Not Congress, not the courts. Nothing.
CircleSeven 1963 Posted January 9, 2018 Author Posted January 9, 2018 The new dereg measure is now posted in the Federal Register. It goes in effect February 7th. That is unless the advocacy groups try to get an "emergency" stay granted from the courts (which is rare).
CircleSeven 1963 Posted January 22, 2018 Author Posted January 22, 2018 And to no surprise, advocacy group Prometheus Radio Project is challenging Pai's new dereg rules in the Third Circuit.

Follow-up. Oral arguments in the challenge of Pai's dereg rules are set for June 11.
CircleSeven 1963 Posted September 23, 2019 Author Posted September 23, 2019 Looks like the court has sided with Prometheus on this one. The Third Circuit has vacated Pai's dereg in a 2-1 vote.

Sounds like Paid Off can appeal this, but time is fast running out unless the rubber stamp right of SCOTUS wants to give him an assist.

The national ownership cap was not part of this media ownership matter. The matter was these changes (ending the NBCO rule and 8-voice test, tweaking the top-4 rule). Pai will no doubt appeal this ruling. But deals involving these rule changes that are pending right now (the KDLT deal to Gray (top-4), the KQTV deal to NPG (NBCO) and the KTTU deal to Tegna (8-voice test)) are in serious jeopardy. Nexstar should be happy that their deal was greenlighted before today's ruling.

Wow. The Third Circuit is not going to hear the FCC's review to appeal of the court's vacation ruling. At this point, there's no other alternative other than taking their appeal to the Supreme Court. And that's going to be an even longer process.
TheRyan 560 Posted November 21, 2019 Posted November 21, 2019 Getting the Supreme Court to rule on this (if they take up the case) should be interesting. Also, I wonder if this delay is going to force Gray to hold off on their plans for KSFY/KDLT.
CircleSeven 1963 Posted April 18, 2020 Author Posted April 18, 2020 So Pai is pressing on...... The Solicitor General (on behalf of the FCC) have petitioned to the Supreme Court to review the Third Circuit's vacation of Pai's dereg rule. The NAB & and a slew of broadcasters have also wrote a similar petition. We'll see if the higher court will hear their appeal. And if so, this would be historic.

I'm surprised Hearst isn't on that list given how much of this effects them the most.
CubsFan79 58 Posted April 18, 2020 Posted April 18, 2020 I'm surprised GRAY TV was not mentioned. Gray tried to buy KGWC TV while still owning KCWY TV. The DOJ/FCC blocked the deal. Now all 3 TV stations are under new ownership.

Basically the parties involved are asking for SCOTUS to overturn the third circuit's ruling on the dereg moves the FCC made in the Fall of 2017 that was overturned by the Third Circuit only because the Third Circuit would much rather keep old regulations to drag down the industry than to allow the industry to survive and thrive (been that way for a while) In short, the third circuit are being obstructionists of anything that the FCC is trying to do
CubsFan79 58 Posted April 19, 2020 Posted April 19, 2020 What are the likely hood of SCOTUS of overturning the Third Circuit's decision. Will the SCOTUS side with the FCC?
CircleSeven 1963 Posted September 28, 2020 Author Posted September 28, 2020 I guess we will know by this week on whether the Supreme Court will hear FCC & NAB's appeal of the Third Circuit ruling.
CubsFan79 58 Posted September 28, 2020 Posted September 28, 2020 I hope the Supreme Court will at least hear the appeal.
CircleSeven 1963 Posted October 2, 2020 Author Posted October 2, 2020 From Reuters, the Supreme Court WILL hear their appeal. I don't think I ever remember the Media Ownership rules being challenged in the highest court in the land.
CubsFan79 58 Posted October 4, 2020 Posted October 4, 2020 It will be interesting to see if the Supreme Court will overturn the third court's ruling. Allowing cross newspaper/TV ownership and owning Two top 4 TV stations in the same market. The FCC and NAB were happy for the SC to hear the appeal. Will see how it plays out.
lugnuts6 91 Posted October 4, 2020 Posted October 4, 2020 It will be interesting indeed.. should the Supreme Court overturn, are we ready for the possibility there's going to be a mediapocalyspe ??
detroiter313 181 Posted October 4, 2020 Posted October 4, 2020 This could be very bad news for every TV and radio station across America....
